The National Secretariat of the Communist Party of India urges the Supreme Court and the government of India to fully protect the rights of LGBTQIA+ community. The party takes note of the decision of the apex court to refer the matter to the five-member Constitution Bench.

The Party condemns the move of the government to appeal in the Supreme Court which is nothing but toeing the line of RSS. This approach of the government is a reflection of its Manuwadi worldview whose basis remains exclusion and criminalization. The denial to recognise the demands of the community stands in direct opposition to the Constitutional promise to ensure right to dignified life to all. Many governments across the world have taken a progressive stance in recognizing the life and rights of the LGBTQIA+ community. The BJP government in fact is pulling back progress and subverting democracy in the country.

The Party appeals to the Constitution Bench of the Supreme Court to take into consideration all the aspects of the issue including the prevailing situation in our country as well as globally and come out with a decision that would fully uphold the rights and dignity of the LGBTQIA+ community.
